Returns and complaints

  • Details of the rules for submitting complaints and returns are set out in the documents:

  • Complaint procedure.
    • Complaints may relate to:
      • on non-compliance of product quality characteristics with the technical specification,
      • on quantitative incompatibilities,
      • on incompatibility of invoiced prices in relation to agreed prices.
    • Complaints should be submitted in writing (by post to the address of the headquarters of the Seller, by e-mail to the address: contrans@contrans.pl or directly to the e-mail address of the trader with whom the Buyer directly cooperates, or by fax to the number +48713254439):
      • on the complaint form,
      • on the Seller's complaint form available on the Seller's website contrans.pl and at the headquarters of the Seller,
    • Complaints should be submitted:
      • within 3 days from the date of receipt of the goods for quantity and price inconsistencies,
      • within 7 days from the day the defect is revealed for quality defects, under pain of losing the warranty rights.
    • Complaints will be considered immediately, but not longer than within 14 days from the date of submission of the complaint.
    • If it is necessary to return the goods to the manufacturer in order to consider the merits of the complaint, the Buyer will be informed of this fact within the time limit indicated in point 6.4. If the expert report shows that the damage occurred as a result of improper use of the goods, the Seller reserves the right to charge the Buyer with the costs of the complaint procedure and expert opinion.
    • The goods will be sent back to the place indicated by the Seller at the Buyer's expense.
    • Lodging a complaint does not release the Buyer from the obligation to make payment for the goods within the set time limit.
  • Returns - The right to withdraw from the contract by the Buyer - Consumer.
    • The buyer who is a consumer within the meaning of art. 22¹ of the Civil Code (hereinafter "the Consumer") has the right to withdraw from a distance contract without giving a reason.
    • The deadline to withdraw from the contract expires after 14 days from the day on which the Consumer came into possession of the item or on which a third party, other than the carrier and indicated by the Consumer, came into possession of the item.
    • The consumer may withdraw from the contract by submitting to the Seller a statement of withdrawal from the contract.
    • To meet the deadline to withdraw from the contract, it is enough to send a statement before its expiry.
    • The Seller is obliged, no later than 14 days from the date of receipt of the Consumer's statement on withdrawal from the contract, return the payment received, including the costs of delivery, except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual delivery method offered by the Seller.
    • The seller may withhold the reimbursement of the payment until the item is received back or the Consumer provides proof of sending it back, whichever occurs first.
    • The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of return that does not involve any costs for him.
    • The consumer is obliged, no later than 14 days from the day on which he withdrew from the contract, return the item to the Seller. To meet the deadline, it is enough to return the items before its expiry.
    • The consumer bears only the direct cost of returning the item.
    • The consumer is responsible for reducing the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
    • The right to withdraw from the contract is not entitled to the Consumer in respect of contracts:
      • for the provision of services, if the entrepreneur has fully performed the service with the express consent of the Consumer, who was informed before the start of the service that after the entrepreneur has fulfilled the service, he will lose the right to withdraw from the contract,
      • in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the contract,
      • in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individual needs,
      • in which the subject of the service is an item subject to rapid deterioration or having a short shelf life,
      • in which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery,
      • in which the subject of the service are things that after delivery, due to their nature, are inseparably connected with other things,
      • in which the Consumer explicitly demanded that the entrepreneur came to him for urgent repair or maintenance; if the entrepreneur provides additional services other than those requested by the Consumer, or provides items other than spare parts necessary to perform the repair or maintenance, the Consumer has the right to withdraw from the contract in respect of additional services or items;
      • in which the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery,
      • concluded by means of a public auction,
      • for the supply of digital content that is not saved on a tangible medium, if the performance of the service began with the express consent of the Consumer before the deadline to withdraw from the contract and after being informed by the entrepreneur about the loss of the right to withdraw from the contract.
